General Terms and Conditions of Use for Car Sharing

PLEASE READ THESE GENERAL TERMS AND CONDITIONS OF USE AND SERVICE (THE “TERMS”) CAREFULLY.
THESE TERMS CONTAIN IMPORTANT INFORMATION REGARDING USERS' RIGHTS AND OBLIGATIONS, AS WELL AS RESTRICTIONS AND EXCLUSIONS. THESE TERMS CONTAIN A MANDATORY WAIVER OF INDIVIDUAL ARBITRATION AND CLASS ACTION/JURY TRIAL RIGHTS THAT REQUIRES DISPUTES TO BE RESOLVED THROUGH INDIVIDUAL ARBITRATION RATHER THAN THROUGH JURY TRIALS OR CLASS ACTIONS.
Welcome to MONEVASION Autopartage et Location Inc.
These Terms are important because, together with your booking confirmation email (the “Booking Confirmation”), they define the legal terms under which our Services are made available to you through our Service. They also cover all interactions or communications you have with us through our Service.
Your use of our Service is subject to your acceptance of these Terms. To book a Service, you must also accept these Terms. If you do not accept these Terms, please do not use our Service or book any Service.
We may modify these Terms at any time. Your future use of our Service following a modification of these Terms is subject to your acceptance of the updated Terms. We recommend that you save or print a copy of these Terms.
In these Terms:
- “Terms” means these General Terms and Conditions of Use;
- “we”, “our” or “us” means MONEVASION Autopartage et location Inc., a Canadian company whose registered office is located at 2265 Boulevard des Laurentides, local 200B, Laval, Quebec, H7K 2J3, Canada;
- “Members” means any individual or legal entity that has created an account on the Platform;
- “Platform” means the MonEvasion platform accessible via the Internet and through the mobile application;
- “Account” means the account that must be created in order to become a Member and access the Services through the Platform;
- “Our Partners” means any affiliated, co-branded or linked website through which our company provides content or a service;
- “Our Service” refers to the provision of our websites, applications and online tools;
- “Service Provider” means Members who make Services available to you through our Platform;
- “Customers” means Members who search for, book or use Services through our Platform;
- “Services” means the services made available to you by the relevant Service Provider(s) through our Platform, such as stays in accommodation or car sharing;
- “you” refers to you, the customer who uses our Service or makes a booking through our Service.
1-Our Service.
Our company, MONEVASION Autopartage et Location Inc., is an online car-sharing and accommodation-sharing platform that connects our “Customer Members” with our “Service Provider Members”. The MonEvasion platform allows “Members” to publish, offer, search for and book Services. It promotes socio-ecological development within the community, strengthens community resilience and reduces dependence on single-occupancy vehicles and the difficulty of finding housing in order to improve quality of life. Our Services are accessible through our mon-evasion.com platform and our mobile application.
As the promoter of the platform, MONEVASION Autopartage et Location Inc. does not own, control, offer or manage any listings. MONEVASION Autopartage et Location Inc. is not a party to contracts entered into directly between “Customer Members” and Service Providers, nor is it a real estate broker, travel agency or insurer. MONEVASION Autopartage et Location Inc. does not act as an agent, in any capacity, for the Service Provider or Customer. Accordingly, every aspect of an actual or potential transaction between a Customer and a Service Provider, including the quality, condition, safety or legality of the vehicles listed, the truthfulness or accuracy of listings (including their content or any review relating to a Customer or vehicle), the ability of Service Providers to rent a vehicle or the ability of Customers to enter into a vehicle rental agreement, is the sole responsibility of each user.
MONEVASION Autopartage et Location Inc. also applies a privacy policy and payment terms.
MONEVASION Autopartage et Location Inc. expressly reserves the right to make reasonable changes to the General Terms and Conditions without notice. Only material changes to the General Terms and Conditions will be announced to Members by email and published on the MonEvasion platform. Changes will be deemed approved if the Customer does not object to them in writing (by fax or email, for example) within one month following the announcement of such change.
2. Service Area for the Rented Vehicle.
In order to rent a vehicle on the MonEvasion platform, you must first comply with the "Service Area", meaning the area within which the vehicle may be rented and returned. This service area for each vehicle rented on our MonEvasion platform must not exceed a radius of 250 km² from the Service Provider's address.
3. Vehicle Eligibility Requirements.
To list a vehicle, you must be at least 21 years old and have 2 years of driving experience. Your vehicle must meet the following eligibility criteria:
- The vehicle must be among the eligible passenger vehicles and must be registered;
- The vehicle must be registered in your name or in the name of your company and comply with all legal requirements;
- Ineligible vehicles include, without limitation, motorhomes, two-wheeled vehicles, vehicles weighing more than 3.5 tonnes, three-wheeled vehicles, vehicles with more than 9 seats, vehicles that can be driven without a licence, vehicles intended for the transportation of goods and animals, vehicles intended for paid passenger transportation, driving-school vehicles, ambulances, taxis, funeral vehicles, vehicles with foreign registration plates or diplomatic or consular plates;
- The vehicle must have a permanent registration plate; temporary plates are not permitted;
- The market value of the vehicle must not exceed CAD $100,000; this value is determined by MonEvasion experts;
- You must provide us with a copy of your purchase agreement to allow our experts to determine the market value of your vehicle;
- The vehicle must not be more than 20 years old;
- The vehicle must be in good working condition and comply with applicable safety and mechanical laws and requirements;
- The vehicle must not have more than 300,000 km on the odometer; Once listed, vehicles that reach or exceed 300,000 kilometres may remain on MonEvasion as long as they are in excellent condition and continue to comply with safety and mechanical laws and requirements, provided that we receive a vehicle inspection report; for every additional 50,000 km, you must renew your inspection report;
- Have a clean title (i.e. not damaged or salvaged);
- You are responsible for checking your vehicle's history and sending us a copy;
- The vehicle must never have been declared a total loss;
- You must maintain your vehicle and ensure that it always meets safety standards and is equipped with the appropriate tires suitable for the weather conditions;
- The vehicle must contain all required safety equipment at the beginning of each trip (e.g., warning triangle and fluorescent yellow safety vest);
- MonEvasion offers supplemental protection equivalent to the actual cash value of the vehicle up to a maximum of CAD $100,000.
4. Registration, Eligibility and Verification
4.1 Registration
You must create an account to access and use the many features of the MonEvasion platform. Registration is only permitted for legal entities, partnerships and individuals aged 23 or older who meet our eligibility criteria below. You represent and warrant that you are not a person or entity prohibited from using the MonEvasion platform under the laws of your place of residence or any other applicable jurisdiction. You must provide accurate, current and complete information during registration and keep your account information up to date. You may not transfer your account to anyone else. You are responsible for maintaining the confidentiality and security of your account credentials and may not disclose your credentials to any third party. You are responsible for activities conducted through your account and must immediately notify us if you suspect that your credentials have been lost, stolen or that your account has otherwise been compromised. You must above all comply with the Highway Code and traffic laws.
4.2 Eligibility
To book a car on our platform, you must meet the following eligibility criteria:
- You must open an account on the platform and accept all General Terms and Conditions of Use (Terms);
- You must have a valid driver's licence issued in Canada or in your country of origin without any restriction on your right to drive;
- You must be at least 23 years old and have at least 2 years of driving experience;
- You must be at least 25 years old to book a vehicle with a market value between CAD $40,000 and CAD $85,000 and have at least 3 years of driving experience;
- You must be at least 30 years old to book a vehicle with a market value between CAD $85,000 and CAD $100,000 and have at least 4 years of driving experience;
- You must provide the Service Provider with a copy of your identification document and driver's licence;
- The Service Provider may require you to sign an additional agreement if they wish.
4.3 Identity Verification
MONEVASION Autopartage et Location Inc. reserves the right to verify at any time the accuracy of the information and documents provided by Customers and Service Providers, and we have the right to conduct investigations. However, we do not approve or guarantee any identity provided on our platform.
User verification on the Internet is difficult and we cannot, and assume no responsibility for, confirming the presumed identity of each user. We encourage you to communicate directly with the Customer or a Member through the tools available on the Site, although this does not guarantee the identity of the person with whom you are communicating. We further encourage you to take other reasonable steps to verify the identity of the other person and, for Customers, the ownership and relevant details of your booking or proposed booking.
EACH USER ACKNOWLEDGES AND AGREES THAT: (1) NEITHER MONEVASION NOR ANY OF ITS AFFILIATED COMPANIES SHALL BE LIABLE TO A USER FOR ANY UNAUTHORIZED TRANSACTION CONDUCTED USING A USER'S USERNAME OR PASSWORD; AND (2) UNAUTHORIZED USE OF YOUR USERNAME AND PASSWORD ONLINE FOR YOUR MONEVASION ACCOUNT OR EMAIL ACCOUNT MAY RESULT IN LIABILITY TO MONEVASION AND OTHER USERS. Furthermore, we may, without notice, suspend or cancel your listing at any time, even without receiving prior notice from you, if we suspect, in our sole discretion, that your account with us or your email account is being used in an unauthorized or fraudulent manner.
5. Conditions to be Observed by Service Providers
5.1 General Rules for Listings
When a Car is registered on MonEvasion, Instant Booking will be automatically activated.
Service Providers may not create more than one Listing for the same Car on the Platform. They must provide truthful, accurate, complete and up-to-date information in their Listing and all supporting documents requested by MonEvasion. Service Providers acknowledge that they are fully responsible for their actions and omissions and therefore represent and warrant that no Listing or Rental violates applicable rules or agreements with third parties. MonEvasion cannot be held responsible for any violation of any agreement entered into between Service Providers and a third party, any failure by Service Providers to meet their obligations to third parties, or any violation of applicable laws, rules and regulations by Service Providers.
5.2 Description and Inspection of the Car
Owners must update the description of the Car in the Listing if its condition changes (i.e., following new damage or repairs). No Owner's claim for compensation will be processed if the relevant Listing is not up to date. Owners must clearly indicate in their Listing the presence of any type of marking or branding (i.e., it must be visible in the Listing photos). If the information is not sufficiently clear, the Car will be suspended from the Platform until the Listing is updated. Owners are required to inspect the Car at regular intervals as requested by MonEvasion. During these inspections, Owners must take photos of the interior and exterior of the Car, describe all existing damage to the Car and provide close-up photos of such damage through the Application.
5.3 Parking Rules
Owners are responsible for:
➜ providing Renters with a reserved parking space for the Car (on the street or in a private parking lot) or
➜ indicating in their Listing an address where Renters will be able to find sufficient free or prepaid parking spaces within a 500-metre radius of that address. In the case of prepaid street parking spaces, Service Providers must specify in their return instructions the limitations of their permit (residential spaces only, etc.).
Owners must provide Renters with adequate directions and instructions for finding and returning the Car (including the full name of the street(s) and postal code) rather than merely providing general instructions such as requiring Renters to park in a free space or on a free street.
5.4 Specific Conditions Indicated in the Listing
Owners may add specific rules and conditions for the Rental of their car(s), provided that they concern:
● the prohibition of smoking in Cars;
● the transportation of animals;
● a minimum and/or maximum Rental period;
● cancellation conditions;
● delivery of the Car for the Rental by appointment to a specific location (for example, airport, train station, etc.) and/or within a specified area. In such cases, the Service Provider must indicate in the Listing the exact address/area and the price charged for such delivery, if applicable.
6. Conditions to be Observed by Customers
6.1 If the Customer is required to contact MonEvasion, he or she shall use the telephone number provided on the platform.
6.2 The Customer is not authorized to allow a third party to drive the rented vehicle on their behalf other than a person listed as an approved driver in the trip details, to drive the reserved vehicle;
6.3 The Customer must perform the mandatory vehicle inspection before starting the rental. Before starting, the Customer must inspect the vehicle and verify that it has no visible defect or damage, significant dirt, or waste inside the passenger compartment or trunk. The inspection, which constitutes evidence, must be recorded on video by the Customer. If defects, damage and/or dirt are significant, the Customer shall contact MonEvasion by telephone to report the nature and severity of the defect, damage and/or dirt, or may require written acknowledgment of such defects from the Service Provider. In order for such defect, damage or dirt to be attributed to the responsible person, it is essential that it be reported before the rental begins. The Customer must provide the corresponding information completely and honestly. MonEvasion has the right to prohibit use of the vehicle if the vehicle's safety appears to be compromised;
6.4 If warning lights come on on the vehicle dashboard to indicate damage and/or a problem, the Customer agrees to report it to MonEvasion immediately and change vehicles. If the Customer does not change vehicles and proceeds with the rental, the Customer accepts the risks and potential liability for damage, including damage caused to the vehicle's tires;
6.5 The Customer is informed and accepts that a tracking device is installed in the car and must not deactivate it under any circumstances;
6.6 Right of withdrawal: There is no right of withdrawal with respect to a transaction you make through the Services, because this right does not apply to services that must be provided on a specific date or during a specific period. Your sole rights are described in the cancellation and refund terms provided by the Service Providers and accepted by you at the time of booking;
6.7 The Customer is also required to:
a) Treat the vehicle with care, in particular by complying with the manufacturer's user manual, break-in requirements, maximum revolutions per minute and gear limits, and the type of fuel to be used in the vehicle;
b) Inform MonEvasion immediately of any damage resulting from vandalism, an accident involving a third party or not, or significant dirt;
c) Protect the vehicle against theft (windows must be closed and the central locking system locked);
d) Regularly check operating fluids and tire pressure during trips and adjust them if necessary – if oil needs to be added, the type of oil to be used must be confirmed with Customer Service;
e) Check whether the vehicle has any apparent defects before driving and report them during the inspection;
f) Comply with all legal requirements relating to the operation and use of the vehicle, including those under the Highway Code and traffic laws,
g) Stop immediately if a warning light flashes on the dashboard and contact MonEvasion to assess whether or not the trip may continue; and
h) When driving an electric car, ensure that the battery is sufficiently charged when leaving the designated service area so that the vehicle can be returned to that area and the charging process can be properly initiated, if applicable;
i) Pay for refueling or charging the vehicle, parking fees and all taxes, fines or tickets received during the rental period.
6.8 The Customer must not:
a) Drive the vehicle under the influence of alcohol, drugs or medication that may impair their ability to drive;
b) Deactivate the passenger airbag, unless necessary to transport children or infants in a booster seat/child seat or to comply with the manufacturer's instructions regarding the installation of child seats. If the passenger airbag has been deactivated, the Customer must activate the passenger airbag at the end of the rental;
c) Use the vehicle for motor sports events or races of any kind;
d) Use the vehicle for vehicle testing, driving training or for transporting persons or goods for commercial purposes (e.g., courier services, food delivery), unless the Service Provider has specifically pre-approved such use in writing;
e) Use the vehicle to transport highly flammable, toxic or hazardous substances generally, to the extent that they exceed household quantities;
f) Use the vehicle to transport objects or substances that could compromise driving safety or damage the interior of the vehicle due to their nature, size, shape or weight, with any damage caused to the vehicle's interior potentially being charged;
g) Use the vehicle to commit offences;
h) Smoke/vape (including any form of cigarettes and e-cigarettes) or allow passengers to smoke/vape in the vehicle;
i) Transport animals in the vehicle unless they are in a securely placed carrier in the trunk;
j) Excessively dirty the vehicle or leave waste of any kind in it;
k) Transport more passengers than the number authorized in the vehicle's registration authorization;
l) Undertake repairs or modifications to the vehicle or have repairs or modifications performed on their own initiative;
m) Transport children or infants without the appropriate booster seat/child seat. The Customer must comply with all manufacturer instructions regarding the installation of child seats;
n) Travel outside the service area with the vehicle;
o) Park vehicles perpendicular to the road or in an inappropriate space, including, without limitation: bus lanes, bicycle lanes, cash-in-transit loading areas, in front of a garage or any other location where parking is prohibited.
6.9 No Liability for Shared Vehicles or Personal Belongings
You acknowledge that MonEvasion is not responsible for the safety, technical inspection or legal status (for example, whether the vehicle is duly registered or has been reported stolen) of any vehicle shared through the Services. Service Providers have full responsibility for ensuring that their vehicles are safe and in good working order, that such vehicles are legally registered and may be driven on public roads, and that they have a clean title. You further acknowledge and agree that neither MonEvasion nor the Service Providers are responsible for lost or stolen property left in a vehicle, or for property taken or damaged during the Rental.
